Legal advice

I have recently had my employment contract with Qatar Petroleum terminated. I was given notice of 3 months with pay (not to be worked). Although this is as per paragraph 4 of my contract with QP, certain events shortly prior to and after this notice being given, clearly indicate a prima facie case of “Unfair dismissal”. I have attempted to resolve the issue directly through the HR department without success. No reply to any correspondence. Is there any authority to whom I may appeal this decision without risking immediate deportation. QP and affiliates are exempt from the Qatari labour laws.

No, not really.
If u have been paid EOS benefit and they have given u notice, everything is in order. And you have received three paid months, which is even more than it should be.
In labour law, and ur contract am sure, it says that at any time ur employer can end the contract with u. and it is alright, as long as you have been given notice and paid for it in full.

unless there has been some very clear case, where u were fired under some very fishy circumstances...u can go to the court.

do check ur contract, it might say in there, that u can be fired without giving any reason...a lot of employment contracts says so.

QP and all other government entities are not subject to Labor Law but rather civil law.

You served 3 months garden leave correct? Why have you waited until now to complain? If you have solids grounds for unfair dismissal (and be careful, check the termination clause in your contract, if it states that either of you can terminate for any reason you may want to seek a lawyer before proceeding).

If you open a case with the court you cannot be deported, but in turn you will also not be allowed to leave the country.

Both responses given thus far are accurate. Do check your contract content related to termination and/or ending a contract. If they do not have to given reason, then you are obligated to accept their formal decision which applies to the rules of the contract - i.e. payments, advance written notice etc....

Read your contract again and also duly advise if their is a "fishy" reason for the same. You need to have pretty good back up docs and data to warrant an unfair dismisal.

If you are hoping to move to another job in Qatar, do consider that rocking the boat formally (if you have the right to) will not see you receiving an NOC.

Torc I am not sure if he will get an NOC from QP, especially if he has been working less than 2 years
