PLEASE ADVISE FOR RESIGNED AND TERMINATION

I INFORMED MY COMPANY WITH NO DESIRE TO RENEW MY CONTRACT OFFICIALLY.

FIRST THEY SENT FOR ME FORM OF END OF SERVICE TO SIGN FILLED IN THE WAY SAYING THAT I DONT WANT TO RENEW THE CONTRACT. (WHICH IS THE TRUE CASE).

BUT AFTER 2 HOURS THEY BROUGHT ANOTHER FORM INSTEAD SAYING THAT THEY END THE CONTRACT AND DONT WANT TO RENNEW IT BECAUSE OF REDUCTION OF FORCES.

WHEN I ASKED WHY THEY SAID THIS IS JUST TO BE ABLE TO OFFER YOU THE NOC BECAUSE THE HEAD OFFICE POLICY SAYS IF U LEAVE BY URSELF THEY DONT GIVE NOC, BUT IF WE END IT THEN WE CAN GARANTEE FOR U THE NOC.

PLEASE ADVICE IS THIS OK AND SHALL I SIGN IT OR THERE IS ANY ILLEAGLE OR DIRTY GAME BEHIND THAT?

You are lucky because the company is still concerned with your issuance of NOC so as you can still apply for jobs with other company, and your termination is in good faith.

However, these are the possible situations: Once you signed it, it seems to appear that you are wilfully leaving and that my have implications to your termination pay, the company may not give you the due termination pay as maybe provided for in your work contract.

This i would suggest, please review your signed contract, it may be provided there that termination can be done in case of labour reduction, subject to proper termination payment and issuance of NOC, etc. SO needless to have that paper again to be signed.

Just review first the work contract signed and confirm it with that new document you are requested to sign. if there is conflict, never sign that new doc, coz the original contract should prevail.

adminstration said same no effect of end of services dues,... just because comany policy is if i leave no NOC BUT IF THEY END IT THERE WILL BE noc

I personally feel that people back in your company do care about you and are trying to extend you this favor. You can check and verify with some previous employee if possoble.

I think your company saying the truth and that if it is your company policy. But you must make sure and secure yourself that telling them to give you in written that after you signed the form, they will give you NOC. When you got a paper written like that, you sign the form.

I resigned once with previous company, and my boss he still gave me NOC.
