NOC -What is the labour law says?
One of the leading Kuwait based Consultant Company terminated more than 50 of their employees from Education City site (Qatar), and they are not willing to give NOC for these peoples, Why this Big company spoiling this employees future ? if they provide NOC how it will affect the Company ? they terminated people with one month notice,
What is the labour law says ? is the employee is eligible to get NOC in Qatar ? If the company terminated people with the completion of project or lack of projects ,
Many of them spend lot of money to furnish their house, and purchased new car and many of them have bank loan, why this big company not understanding this ?

This is the actual problem, the labor law does not say anything about the No Objection Certificate, all what is posted online is from people's experiences. No one tells you anything until it happens to you and you find out after it is too late.
I heard at work that if you are offered three times your basic salary then you get an automatic NOC! This sounds a bit stretched and wishfull thinking, but is it really so?

And remember the same people who are practicing the modern slavery are praying today thanking God for the opportunity to do so
sponsorship law has not changed.
This week at work, I heard that the employer sponsorship requirements in Qatar will be cancelled altogether. And that this would be announced around the 3rd week of May 2011. Has anyone heard or knows anything about this development? Or is it just a rumour? I have searched the net for the last two days now in vain.
No luck thus far :(
Issuance of NOC is at the discretion of the employer.

This is the text of the Labor Law of Qatar:
Any condition in a service contract shall be void when it contains an undertaking by the worker to work for the rest of his life with the employer or to abstain from
carrying out any craft or profession which may be carried out after leaving the work even if the contract is agreed before the coming into force of this law.
If the nature of the work allows the worker to know the clients of the employer or the secrets of the business of the establishment, the employer may stipulate that theworker shall not compete with him or participate in any undertaking competing with him after expiry of the contract. Such stipulation shall be valid only if it is restricted as to its duration and place and to type of the work to the extent necessary for the
protection of the legitimate interests of the employer. The period of such undertaking shall not exceed two years."
What is said here is that the ban should not exceed two years. It doesn't say that it has to be two years.
And then this:
"According to Article 2 of Law No.3 of 1963 amended in conformity with law-decree No. (5) of 1981- O.G. 5/1981, the work visa shall not be granted before a two-year-period since the last departure of the foreigner who had already worked in the country. However in matters of public interest, the Minister of Interior may grant this visa without abiding by the aforementioned period.
Issuance of NOC is at the discretion of the employer."
Here it clearly states a two year ban. God knows which monkeys wrote these laws.

This Company got a good name in Market,
They have many projects in education city........
simply without any reason, they terminated many Technical ppl ……. Some of them parked their lone based car in the Airport parking b4 they fly

it is so bad in this country,its just the only place in the world with modern day slavery.the whole world should be made to know the truth about QATAR
The question is not about "has" or "should".
The question is the employers' obligation under existing labour law .
Just to put another question here. What would be the scenario if the terminated person has a bank loan against him? Will the bank adjust the loan from the Insurance? or?
In this situation where a employer terminates a contract an NOC should be automatic, i.e the employer HAS to give one....Qatar needs to wake up here if they want to attract quality people!
Labour dept needs NOC from the Sponsor regardless the project was completed or being terminated due to no reason...
Qatar have to do a lot to impove their Labour and Immigration rules for the benifit of both the Employees and the Employers.
We have a clear case of 'Modern Slavery' here. And, of course, family destruction is a favorite sport in Qatar!
