If he's caught ..."in the act" then he deserved to be beaten but maybe not to such an extent that he died.
I don't like the US terminology of "use deadly force".

as a dad...i have no problem with what the fellow did..

stealth ...I would suggest enough to make him realise that he was wrong but enough to kill him?
I'm not saying it shouldn't be a capital offence but at the moment it isn't.
I would probably have reacted in a similar fashion myself but would like to think that I knew when to stop and call the cops.
