need help for my husband

mga kabayan, baka naman po may ilan sa inyo na katulad ng situation ng hubby ko. he's an engineer po kase, i just came here under his sponsorship nun feb 2008 and now working here. finished contract na po sya sa current employer nya and overseas hire sya. ang problem po, ayaw nya na sana magrenew sa company nya because he's not being compensated well, madami na ngayon tumatatwag sa kanya na magagandang company at mas magandang offer ang kaso ayaw naman magbigay ng NOC/release ng company nya...ano po kaya ang best option nya? aside from staying sa company nya? ayaw nya naman po sana umuwi kase ibig sabihin kelangan ko din umuwi kasama nya...

 salamat po!

he cannot transfer to another company/sponsor, he still need the NOC to transfer to a new Employer/Sponsor.

 

just one question though, why did he accept his contract if he knows he's not being compensated enough?

you'll never know whether you have been compensated well unless you actually land in the place of work...he's a hardworking person and rarely complains...compensation does not only mean currency but also involves appreciation of a very good work done by an employee...hope i answer ur question,

yah i agree with you i've seen a lot of those here.

 

anyway, if your husband do have a prospective employer already. and they are really eager to acquire him, what he can do is to talk to them and ask them to approach his current employer/sponsor. i myself came from a same situation where my sponsor does not issue a NOC, but what my prospective employer did is they themselve approach my current sponsor and talked to them and they did issue a NOC for my transfer. a friend of mine also with the same situation did the same thing. hope this helps :)

first of all, thats a problem indeed. If the company wont release him despite the fact na ayaw na nya mag renew, he is pinned down to the company. the only option he has is to get a job outside qatar, plan for a vacation, get an exit permit, and dont come back to qatar anymore, at leat until after 2 yrs time.

your best option is hawker's suggestion. proven na and i also think thats the best option. If your husbands prospects really wants him they will do their best to talk to his present sponsor ....

 

or just renew his contract now, since it would be better than going home sa pinas and i presume u also have a job now here.  however in the meantime, try applying from other countries where he can get have better compensation ... konting sacrifice lang ...

 

it would also help if u have a "wasta" ... i mean qatari with influence to talk to his present sponsor ....

it seems you're in a tight bind. except in cases of bankruptcy, companies do not usually grant NOC since this will encourage employees to leave for other companies given the opportunity. its a simple management logic.

 

we must all understand that OFW's don't usually have all the choices in this part of the world. we all know about existing sponsorship laws in qatar so in your situation, your choices are either you stay put or bail out. so my advice to your husband, is to manage his career by seriously studying his options. so before accepting job offers (regardless of salary), research about the company & try to see whether or not there are growth opportunities for him there. paano kung mataas nga ang pa-sweldo then mataas din ang performance expectations? tapos di kinaya ng husband mo? preventive is always better than corrective...

 

before accepting a job, he should ask about his prospective employer's policies on compensation, performance evaluation, & reward & recognition. in this way, he can be sure that his performance will get the recognition he deserves once he is hired.

 

so if your husband thinks he no longer have a future with his employer, then leave & take the risk while trying out in other countries.

 If there were contract violations, you can approach the ministry of labor or the human rights committee. they will force the employer to release your husband if the company is in viloation of the agreement.
