Regarding resignation and offer letter clause

I have signed an offer letter that has an agreement of understanding stating that when contract is still active, without approval I should not change visa otherwise will be penalised of 35,000 QR. But I am not feeling in this new country and health is not proper so i want to give resignation. Its a private clinic. Please advice. if they dont approve what should i do

I have signed a contract of two years at Qatar visa centre in India and I have a one month of Probation period but as I came here, my health is not in a good state and moreover I feel I can't work further as I have been to clinic many times they change so many rules like , now they are telling me if I don't have patients to treat I can't get salary, before they said no need of Prometric license now they are asking me to write like that and more over its affecting my mental health. after Eid I ll be joining and I have one month probation and many told me if my contract is still active and I don't like the job or my health is at risk, I can give notice of one month and can leave. Is that true. Please guide me. Even in labour laws also it was mentioned one can leave the job if we don't like even though contract is active. please

During the probation period, either party can terminate the employ. You will need to check your offer letter thoroughly for terms and conditions. I do not know if the Company refund for Visa, placement, ticket etc etc still apply since you want to leave and not the company removing you.

As I understand, you are planning to go back to your country permanently. If you have not signed a Contract yet, you can resign by giving a one month notice to the company. However, if you have signed a Contract, read the terms of the Contract. Possibly, it allows you to resign and leave the company by giving a month's notice. If so, then you can leave by giving a the company a month's notice in writing. Don't worry about the QR35000 penalty as you are not changing over to another company in Qatar.
