Breaking News on the Sponsorship Law

Should have written heart breaking news for all the eagerly waiting expatriates.

In todays Gulf-Times i.e of Friday April 18, 2008 they have published the legislation draft of the new proposed sponsorship law . The law that was supposed to change the imbalance between the rights and duties of the masters towards the slaves.

But it looks as if our please have fallen on deaf ears and masters will always be masters and slaves will always be slaves for the time being. We need the Messiah.

expatriates can expect few sponsorship law changes

of sweeping changes to the sponsorship law appear to have been dashed,
according to details published in the Al Arab newspaper yesterday.
A
copy of the draft legislation obtained by the newspaper revealed little
or no change to the current regulations that affect expatriates working
in Qatar.
The freedom of movement of non-Qataris would still be restricted through the mandatory issuance of exit permits.
However,
the draft does make it illegal for sponsors and employers to retain
employees’ passports and travel documents once their residence permits
have been issued, unless both parties agree in writing otherwise.
It
is mentioned that the Minister of Interior (MoI) has the power to order
deportation of any expatriate deemed a threat to the national security
or to public order or public health/national economy.
The minister is allowed, if needed, to suspend the deportation of an expatriate for 30 days extendable for one similar period.
The main clauses of the draft law, as published by Al Arab, are as follows:
An
expatriate who was deported for a legal or administrative reason cannot
return to the country without a decision from the minister.
The
minister can approve the transfer of sponsorship of a worker/employee
if there is a dispute between the employee and the employer.
Any
expatriate once deported after a court verdict, will not be able to
re-enter the country, unless authorised specifically by the MoI.
Any
one recruited by a company is not allowed to work for any other
company, while the sponsor is not allowed to employ workers not under
their sponsorship.
However, authorities can make exceptions by
giving authorisation to sponsors for up to six months which is
renewable. Authorities can also give permission to expatriates to work
part-time, but there should be written permission from the original
sponsor.
Sponsors/companies cannot sell/trade their visas for any amount of money.
An
expatriate is able to sponsor his son(s) as long as they are students
until the age of 25, while in the case of daughters for as long as they
are not married.
Expatriates are not allowed (except women who are
on sponsorship of their spouses, minors/visitors) to leave the country
- temporarily or for good – unless they get an exit permit from the
sponsor.
In case it is not possible to obtain an exit permit because
the sponsor refused/or in case the sponsor died/or is absent and there
is no one else to act on behalf of the sponsor, the expatriate can
either advertise his/her intention to leave the country in at least two
newspapers once and within 15 days of publishing should get the
certificate that no court case/or lawsuit is pending against him/her,
or should seek any one who will guarantee the exit.
The MoI will
issue visas and (Residence Permit) RP for investors in huge projects,
real estate owners, and other categories defined by the Council of
Ministers.
The duration of this RP is five years, extendable for
similar periods, and the holders can leave the country without getting
exit permit.
Those who are granted RP under this category are
allowed to get RP, without provision for taking up jobs, for their
spouses, sons and parents.
Expatriates accused of violation of any
law cannot leave the country before paying the fine or before a final
acquittal decision from a court of law.
Or the individual concerned can be allowed to leave if he/she provides someone who is ready to provide guarantee to pay instead.
The
law is not applicable for heads of foreign states, their family members
and companions, heads of diplomatic missions, and attaché members and
official delegations, and captains of ships.

looks like there's nothing much to expect on this law. Qatar is unlikely to follow what other GCC states are doin now...how about a little flexibility on the new law? they choose to be deaf and blind....

Till yesterday morning i have been waiting for the NEW sponsorhsip law, which can allow me to change my current company where i have been spoiling my life for 10 years. As there are many opportunities in Qatar, the expected law was a dream...but, it dashed...NEW LAW WITH NO CHANGES...it is correct....Now the attitude of employers to the employees (modern slaves) will be more worse....There is a sentence that the minsiter can can allow sponsorship change, if there is DISPUTE between the employer and employee....but there is no DEFINITION for DISPUTE.....All employees are in dispute with the employer for BETTER SALARY....No way...now, better to skip Qatar at the earliest...

This Sponsorship & exit permit thing was the reason for me not supporting

the "Expat voluntereers for Asian Games".

 

Not only that these organisers did not even have the  courtesy by returning

the volunteers favour by droping them home. (These guys were voluntering 

after putting in more than 8 to 10 hrs work). Providing food and transport

was the minimum courtesy the organisers could have extended to the 

"helpers/volunteers".

 

Many of the volunteers thought that they would get paid. I want to see if they 

get any volunteers for the Olympics at all. 

 

And why should anybody volunteer  to work  with the Games organising

committee since it is "Illegal to work for/with someone other than your

sponsor".

It is only the draft which was published. You do not expect them to publish one which says that the NOC will be canceled, as that would create a major chaoes with the current system.

 

Chances are that the NOC will be eased in the final law, Qatar just cannot afford to remind the entire world about such a law.

just a pieace of my thought...

at first, when we applied for a job, i believe we should have atleast a lil' knowledge of the system here in qatar, and for that we're able to accept it and work r asses out here. why not have some time to let the gov do their job and wid god's grace we'll all be satisfied.

we shud not be thnking dat we're slaves here (it degrades me to think it that way) and the employers (for which some r locals) r our masters, for they too have the share of burden you know.

what i understand is whether this law have some lapses/biases, still most of expatriates whom of which i know and hav seen here where able to enjoy things that aren't probly feasible to achieve when they're in their respective home countries and the benefits as a whole are atleast satisfactory. that's why we decided to leave our own country and work here in the first place.

i only wish, probably for this law that it will be, atleast applicable for humans, not compromising human rights in which some violates.

as an advice...
we're able to stay of up to, say 2yrs? 5yrs? 10yrs? why not wait more, it doesn't hurt a bit, just do our jobs, abide the laws and we're all be just fine (hope so) 'til we're stuffed enough wid savings that going home (or somewhere else) will be an ultimate destination to settle.

this is their country, the least thing we can do is to respect them and their laws and cultures. we r the expatriates, the least thing they can do for us... will soon be unfold???

Nothing Gonna Change, it seems. It reminds me Zamindaari regim of Old Indian Society. The world changing towards the good n the best by adapting the good n human governance. Its pitty to see we are going down in the record of humanity. n nobody cares! isn't it great? I feel good to see few nationals comes to justify and give proof of their nationalism here on QL. I too love the place where I live. But, I never prefer to be "yes boss" if its wrong. I have seen people justifying the unreasonable price hike in food grains and housing of Qatar by comparing it with London. My question is do you think you are comparing apple to apple? Anybody has answer, what will happen to a man who can't go and attend funeral of his brother because of non issuance of exit permit at right time? ........I love Saudi Arabia because of holiness attached with the land, but the inhuman law of the governance their has prevented me to attend my sister's marriage. I pray to Allah Subhanahu, to make them understand the correct meaning of Islamic governance, which nowhere in Muslim country exist. N no one dare to speak, not even our ulemah-e-din.

Well... did you think that the people behind this is by themselves making  "Slavery" of their employees? .. Of Course! of how many percent of companies here is not owned by them? if they do approve the new sponsorship or labor law or whatever they called it, it would only benefit themselves and not for us so called "expatriates". well that's it if they finally signed this LAW then all of the Rude Bosse's are smiling their Hearts out! they won again!
